This Text Messaging Privacy Policy (“SMS Privacy Policy”) explains how Golden State Orthopedics & Spine (“Brand,” “we,” “us,” or “our”) collects, uses, and shares information in connection with our SMS/MMS text messaging program (the “Messaging Program”).

1. SCOPE

This SMS Privacy Policy applies when you take the following action, with regard to employment communications:

  • Provide your mobile number and opt in to receive SMS/MMS messages from us;
  • Receive messages from us; or
  • Send messages to us (including keyword messages such as STOP or HELP).
2. INFORMATION WE COLLECT

We may collect the following categories of information in connection with the Messaging Program:

A. Mobile and subscription information
  • Your mobile phone number
  • Opt-in and opt-out status
  • Consent records (e.g., date/time, source, and method of opt-in)
B. Message information
  • Messages you send to us and messages we send to you (including message content)
  • Timestamps, delivery status, and routing information
  • Interactions with keywords (e.g., STOP, HELP)
C. Related account/contact information (if applicable)
  • Name, email address, account identifiers
  • Information necessary to provide the messages you request (for example, interview details if the program includes reminders or alerts)
D. Website/app information (if you enroll via web/app)
  • Device identifiers, IP address, browser type, and log/usage data (as applicable)
3. HOW WE USE INFORMATION

We use Messaging Program information to:

  • Deliver the messages you requested, such as interview details
  • Maintain consent and preference records and process opt-out requests;
  • Help detect and prevent spam, fraud, abuse, and policy violations; and
  • Comply with applicable law, carrier/industry requirements, and enforce our policies.
4. MESSAGE FREQUENCY; MESSAGE AND DATA RATES 

Message frequency for recruitment is episodic; there is no standard frequency. Message and data rates may apply based on your mobile carrier plan.

5. SHARING AND DISCLOSURE 

We may share Messaging Program information with:

A. Service providers: We use vendors to help operate the Messaging Program (for example, messaging platform providers, telecommunications carriers, analytics, and support providers). These vendors process information only to provide services to us and at our direction.

B. Legal and safety: We may disclose information to comply with law, respond to lawful requests, protect rights/safety, or investigate fraud or abuse.

C. Business transfers: We may share information in connection with a merger, acquisition, or sale of assets.

IMPORTANT – NO SHARING OF MOBILE INFORMATION FOR MARKETING No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. We do not sell, rent, or share your mobile number or Messaging Program opt-in information with third parties or affiliates for their own marketing or promotional purposes, and we do not share mobile opt-in information with lead generators.

6. TWILIO CONTENT COLLECTION AND MONITORING (U.S. AND CANADA) 

Our Messaging Program may be delivered using Twilio and other providers. For messages sent to U.S. and Canadian phone numbers, Twilio may collect and monitor the content of messages to detect spam, fraudulent activity, and violations of applicable policies. By participating in the Messaging Program (and, where applicable, by sending messages to us), you acknowledge this notice and consent to such processing and monitoring for these purposes.

7. YOUR CHOICES 

Opt-out: You can opt out of the Messaging Program at any time by replying STOP (or another supported opt-out keyword) to any message. After opting out, you may receive one final confirmation message. Help: Reply HELP for help, or contact us at:

8. DATA RETENTION 

We retain mobile information, consent records, and message logs as needed to operate the Messaging Program, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods may vary depending on the program and legal requirements.

9. SECURITY 

We maintain administrative, technical, and physical safeguards designed to protect Messaging Program information. No system is 100% secure.

10. CHILDREN

The Messaging Program is not intended for children under 18, and we do not knowingly collect mobile information from children.

11. CHANGES TO THIS POLICY 

We may update this SMS Privacy Policy from time to time. The “Effective Date” above indicates when it was last updated.
